Introduction and Acceptance of Terms

Welcome to HeartMuLa, an open-source AI music foundation model designed to generate professional, studio-quality music from text descriptions. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

HeartMuLa provides users with an AI-powered platform to generate music from text descriptions in multiple languages. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

Beta Service Notice

HeartMuLa is currently in beta testing. During this period, the service is provided free of charge. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

User Accounts and Registration

  1. Account Creation: To access certain features of the service, you may need to create an account. You must provide accurate and complete information during the registration process.

  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  3. User Responsibilities: You agree to notify us immediately at heartmula.ai@gmail.com of any unauthorized use of your account or any other breach of security.

Generated Music and Content Rights

Your Rights to Generated Content

  • Generated Music: You retain ownership of the music you generate using HeartMuLa.
  • Commercial Use: You are permitted to use generated music in your commercial projects, including but not limited to YouTube videos, podcasts, games, advertisements, and other media.
  • Attribution: While not required, we appreciate attribution to HeartMuLa when you use generated music publicly.

Platform Rights

  • The HeartMuLa AI models, code, training data, and infrastructure remain the intellectual property of the HeartMuLa project and its contributors.
  • You may not claim ownership of the HeartMuLa platform itself or misrepresent your relationship with the project.

Open Source License

HeartMuLa is an open-source project. The source code, models, and documentation are available under the terms specified in our GitHub repository at https://github.com/HeartMuLa/heartlib. Please refer to the LICENSE file in the repository for specific terms regarding the use and distribution of the open-source components.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using HeartMuLa:

  • Using the service to generate content that infringes on the rights of others
  • Using the service to create harmful, illegal, or offensive content
  • Attempting to reverse engineer, decompile, or extract the AI models (beyond what is permitted by the open-source license)
  • Interfering with or disrupting the security or performance of the service
  • Using automated systems or bots to abuse the service or create excessive load
  • Misrepresenting music generated by HeartMuLa as being created by human musicians (without disclosure)
  • Using the service for any illegal or unauthorized purpose

Content Moderation and Quality

  • We reserve the right to moderate, reject, or remove any generated content that violates these Terms or is deemed inappropriate.
  • We do not guarantee the quality, accuracy, or suitability of generated music for any particular purpose.
  • Generated music may occasionally contain unexpected artifacts or imperfections due to the nature of AI generation.

Privacy and Data Collection

HeartMuLa collects the following types of data:

  • Account Information: Information you provide when creating an account (name, email)
  • Usage Data: Text prompts, generation parameters, and usage statistics
  • Generated Content: Music you generate may be temporarily stored for processing and quality improvement
  • Technical Data: Device information, IP address, and browser type

Content Storage and Deletion

  • Generated music files may be temporarily stored on our servers for processing purposes.
  • You are responsible for downloading and storing your generated music. We do not guarantee long-term storage of your content.

Pricing and Payments (Future)

  • During the beta period, HeartMuLa is completely free to use with unlimited music generation.
  • We reserve the right to introduce paid plans in the future. Existing users will be notified in advance of any pricing changes.
  • Any future paid features will have clear pricing information available before purchase.

Service Availability and Limitations

  • We strive to maintain high availability but do not guarantee uninterrupted access to the service.
  • Music generation may be subject to rate limits or usage caps to ensure fair access for all users.
  • We reserve the right to modify or limit access to features during beta testing.

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties, including but not limited to:

  • Abusive or excessive use of the service
  • Fraudulent or illegal activity

Indemnification

You agree to indemnify and hold harmless HeartMuLa, its contributors, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the service
  • Music you generate and distribute
  • Violation of these Terms
  • Violation of any rights of third parties

Research and Academic Use

HeartMuLa is backed by academic research (arXiv:2601.10547). If you use HeartMuLa in academic or research contexts, we encourage you to cite our research paper and acknowledge the open-source project.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable international laws and conventions governing open-source software projects. Any disputes arising from these Terms or the service will be resolved through good faith negotiation or, if necessary, binding arbitration.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website.
